Kelly Timilty held on to her 2nd District Governor's Council seat Tuesday, despite news breaking late in the day that her campaign distributed a flyer featuring a forged endorsement from Gov. Deval Patrick.
Timilty, a Dedham Democrat, held off primary challenger Robert Jubinville, of Milton, by 32 percent. The final tally showed Timilty receiving 66 percent of the vote and Jubinville earning 34 percent.
The results indicate that news of Timilty mailer likely played little if any role in the results. Patrick's (D-Milton) political committee has said that it is looking into the "legal implications" of Timilty's forging the endorsement and Patrick's signature.

News of Timilty's dirty trick came too late
What role the news of Timilty's mailer played in yesterday's results is much less important than what role the mailer itself played in the final outcome. News of Kelly Timilty's dirty trick came too late in the day to have much of an effect on the vote. Not so the "endorsement" from the Governor.
I admit that, when I received the card with what appeared to be the Governor's endorsement and the Governor's signature, I stopped for a moment to reconsider my choice in the race. However, my knowledge of Kelly Timilty's lack of commitment to her office sealed the deal for me. Still, the Governor's imprimatur carries weight. I'm certain it swayed many voters who didn't know much about either candidate. Little did they know it was a forgery and a lie.
Kelly Timilty defrauded the people of District 2. She should step down from the Governor's Council and remove herself from the November ballot. And I hope she is prosecuted to the full extent of the law, which says:
M.G.L. c. 56 sec. 41A: Unauthorized use of endorsements
Section 41A. No person shall, in order to promote his success or the success of another as a candidate for nomination or election to any public office, or in connection with any question submitted to the voters, include or cause to be included in any political advertisement, circular, poster or publication, the name of any person as an endorser or supporter except with the express consent of such person. Violation of any provision of this section shall be punished by imprisonment for not more than six months or by a fine of not more than one thousand dollars.
It's time for Secretary of State Galvin, Attorney General Martha Coakley, the Massachusetts Democratic Party, and the Ethics Commission to take action.
