Why couldn't he be ethical and go to a scalper?

So Pittsfield Mayor James Ruberto is in a bit of a pickle, as the state Ethics Commission is on his case about purchasing 2004 World Series tickets at face value from former BoSox GM Dan Duquette.

At the time, Duquette's then Berkshire Dukes were waiting for approval to play at the historic Wahconah Park. According to the Patriot Ledger, Duquette told the commission he sold Ruberto the tickets to advance the team's move, which the now Pittsfield Dukes made from Hinsdale in 2005.

Sure, the ethic's panel has a solid point: Ruberto was trading on the influence of his office to get cheaper tickets not available to the public. But is there a not something ironic here? Maybe that scalpers who charge ten times a ticket's original value are the ethical alternatives in this equation?
